The Barrow County Sheriff’s Office arrested Jose Emilio Peralta Villafana, who faces multiple charges, including homicide by vehicle.

According to the Georgia Gazette, Villafana also faces charges of Georgia criminal alien tracking and reporting, no insurance, operating an unregistered vehicle and following too closely. He was booked on March 28.

Under Georgia law, second-degree homicide by vehicle is classified as a misdemeanor. The offense is punishable by up to 12 months in jail when a traffic violation results in death but does not involve a felony-level conduct, according to Bubba Head Attorneys.

The Barrow County Sheriff’s Office, led by Sheriff Jud Smith, serves as the primary law enforcement agency for Barrow County, with responsibilities including uniform patrols, criminal investigations, detention operations, school resource officers, warrant processing, and traffic safety enforcement, according to the Barrow County government.
