CJ Pearson, Co-Chair of the GOP Youth Advisory Council, has criticized the Biden administration for allegedly misusing whistleblower laws for political purposes. He praised President Trump and Attorney General Pam Bondi for their efforts in restoring integrity at the Department of Justice. Pearson made these remarks on X.
“Whistleblower laws shouldn’t bankroll political hit jobs,” said Pearson. “Biden’s DOJ turned the False Claims Act into a racket. THANK GOD PRESIDENT TRUMP AND AG BONDI ARE CLEANING UP THE DOJ.”
The Biden administration has expanded the False Claims Act (FCA) through the Department of Justice’s Civil Rights Fraud Initiative. This initiative utilizes the FCA to address alleged misrepresentations in diversity, equity, and inclusion compliance by federal contractors. Critics argue that this expansion stretches the law beyond its original intent, while supporters believe it holds institutions accountable for civil rights obligations. According to Reuters, this represents a significant shift from traditional fraud cases that primarily focused on financial misconduct.
False Claims Act recoveries in fiscal year 2024 surpassed $2.9 billion, driven by 979 qui tam whistleblower lawsuits—the highest number recorded. More than $2.4 billion of these recoveries were initiated by whistleblowers, highlighting their crucial role in enforcement efforts. The U.S. Department of Justice reports that FCA activity continues to grow, with healthcare and pandemic-related fraud being among the largest sources of settlements.
By mid-2025, the DOJ announced 128 FCA settlements totaling approximately $1.26 billion, with over 80% related to healthcare and Paycheck Protection Program fraud. About two-thirds of these recoveries originated from whistleblower suits, maintaining continuity with previous years. Reuters reports that the Biden administration has also expanded enforcement to include DEI compliance and trade issues, broadening the traditional scope of the FCA.
