Superior Court Judge Brian Amero has dismissed a Fulton County case seeking a review of 147,000 absentee ballots amid claims of alleged fraud during the 2020 election.

“Joe Biden won, Donald Trump lost – it’s time for the other side to face the facts and move on,” Fulton County Board of Commissioners Chairman Robb Pitts wrote via Twitter on Wednesday in response to the news.

The lawsuit, filed in December, alleged evidence of fraudulent ballots and improper ballot counting in Fulton County, according to the Associated Press.

Amero dismissed the case filed by nine Georgia voters, stating it “failed to allege a particularized injury" and therefore could not maintain their state constitutional rights had been violated, AP reports. 

The result was celebrated by Pitts, who told AP the decision was a win for democracy, claiming the lawsuit was the result of conspiracy theories from people who couldn’t accept they had lost.

According to the article in The Sacramento Bee, Garland Favorito, who spearheaded the lawsuit, plans to appeal the judge’s decision, stating evidence has been prepared to support their allegations. He told AP it is not adequate for an organization to secretly report there are no counterfeit ballots and then refuse to allow public inspection.
