Gov. Brian Kemp continues to fight the Biden Administration’s efforts to require vaccine mandates for private businesses.
Reuters reported that a federal appeals court had already granted an emergency stay on the Biden Administration's private business vaccine mandate, which the 5th Circuit Appeals Court upheld last week.
"The mandate is a one-size-fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces (and workers)," Circuit Court Judge Kurt Engelhardt wrote for the panel, according to Reuters. "The public interest is also served by maintaining our constitutional structure and maintaining the liberty of individuals to make intensely personal decisions according to their own convictions – even, or perhaps particularly, when those decisions frustrate government officials."
While the 5th Circuit Court granted and upheld the stay, Georgia's lawsuit was filed in the 11th Circuit Court.
Gov. Kemp took to Twitter to state his support for the stay with hopes that Georgia will soon also be victorious in their suit.
"The 5th Circuit U.S. Court of Appeals just halted Biden's vaccine mandate on businesses w/ 100+ workers. This is a good indication for the lawsuit GA filed in the 11th," he wrote. "We will continue our legal efforts and are confident this unlawful, unconstitutional order will be struck down."
The legal skirmishes were filed once the Biden Administration issued a vaccine mandate for private businesses, according to NPR.
“This unlawful mandate is yet another example of the Biden Administration’s complete disregard for the Constitutional rights afforded to our state and our citizens,” Georgia Attorney General Chris Carr said in a press release. “The federal government has no authority to force healthcare decisions on Georgia’s companies and its employees under the guise of workplace safety. We are fighting back against this unprecedented abuse of power to stop this mandate before it causes irreparable harm to our state and its economy.”
