The Georgia Senate has approved Senate Bill 69, a legislative measure aimed at regulating Third-Party Litigation Financing (TPLF) in the state. The bill, introduced by Senate President Pro Tempore John F. Kennedy of Macon, seeks to protect consumers and enhance transparency within Georgia's civil justice system.
"Our civil justice system should not be treated as a lottery where litigation financiers can bet on the outcome of a case to get a piece of a plaintiff’s award," said Senator Kennedy. "SB 69 establishes critical safeguards for an industry that continues to expand each year."
Kennedy highlighted concerns about the U.S. commercial litigation industry's control over an estimated $15.2 billion in assets without existing consumer protections for plaintiffs involved in these financing arrangements. He emphasized that this situation has led to everyday Georgians being exploited by predatory financiers who profit at their expense.
Senator Kennedy also expressed concern over foreign-affiliated financiers manipulating the legal system and influencing court outcomes through unregulated third-party financing. "SB 69 will require litigation financiers to register with the state before operating in Georgia and will ban foreign adversaries from engaging in litigation financing here," he stated.
Governor Brian P. Kemp supports SB 69, underscoring tort reform as a top priority for the 2025 Legislative Session during his recent State of the State address.
