Board of Zoning Appeals to hear 3 variance requests from property owners

City of Milton issued the following announcement on October 18.

Milton’s Board of Zoning Appeals is set to meet Tuesday evening to hear three variance requests for properties around the city.

The October 19 meeting will start at 6 p.m. in City Hall’s Council Chambers. In addition to attending in person, people should be able to watch it live at https://www.youtube.com/watch?v=AZNyUo3jzLI&list=PLpkXg669ndraS4Kii4znC0Qq4u-WvGzxZ&index=5.

The Board of Zoning Appeals (or BZA) is a quasi-judicial body that hears variance requests as well as appeals to City decisions related to zoning ordinances, stream buffers, and sign permits. Its votes must be guided by City Code, including its zoning standards. BZA decisions can be appealed to Fulton County Superior Court.

The first variance request that the BZA will consider relates to 2640 BETHANY CREEK COURT, a property not far from the intersection of Hopewell Road and Bethany Bend. The applicant is asking for a house that was built encroaching 8 feet into the rear setback to be brought in compliance.

The next relates to a property at 13705 BRITTLE ROAD. The applicant there is requesting a new barn housing animals to be less than 100 feet from the south property line and for an accessory structure to remain in the property’s rear building setback.

The final item pertains to 355 GUNSTON HALL CIRCLE further west in Milton. The property owner there is asking for a reduced side-yard setback (from 25 feet to 12.5 feet) for the construction of an additional garage.

Milton’s Design Review Board discussed all three requests earlier this month.

After Tuesday’s meeting, the Board of Zoning Appeals is next scheduled to convene the night of Tuesday, November 16.
