Georgia small business owners back Kemp's tort reform proposal

Jan 30, 2025

Governor Brian Kemp has introduced a bill aimed at addressing lawsuit abuse in Georgia. The proposed tort reform has been met with approval from small business owners across the state. NFIB State Director Hunter Loggins expressed support for the bill, emphasizing its potential benefits for local businesses.

"Small businesses are the backbone of Georgia’s economy, but many local businesses are struggling under the weight of excessive litigation costs," Loggins stated. He added that Governor Kemp's plan would allow these businesses to focus on growth and job creation instead of dealing with costly legal battles.

The proposed reforms include several measures designed to alleviate burdens on small businesses:

- Lower insurance costs by addressing liability issues related to criminal acts beyond a business's control.

- Fair medical damage awards by ensuring juries consider actual medical expenses rather than inflated figures.

- Protection from frivolous lawsuits through limitations on misleading tactics used by attorneys and unwarranted case dismissals.

- Third-party litigation financing reform to regulate lawsuit funding and protect against bad-faith litigation financed by hidden investors.

Loggins highlighted that these changes would create a "fairer, more predictable legal landscape" for small businesses, allowing them to operate confidently and reinvest in their operations without fear of baseless claims. He urged legislators to support this legislation.
